Who We Are

We are an institution of Local Governance called “Urban Local Body” (ULB). There are various categories of ULBs in Uttar Pradesh and we are classified as a “Nagar Palika” type of ULB.

We are constituted as per the Constitutional provisions in the Constitution of India. The 74th Amendment promulgated by the Parliament in the year 1992 has provided the framework for our existence.

The Uttar Pradesh Government has introduced the necessary changes in the Acts governing the Urban Local.

Who Governs Us

Being an institution of Local Government we have a distinct difference between the two wings

    • Legislature and
    • Executive

Our Legislature is a governing Body. This Governing Body which is elected by the citizens living within the geographical area of ours. The geographical area has been carved out into – electoral wards. Each ward elects a representative to be sent to the Governing Body. The other members of the Governing Body are :

      • MLA
      • MP
      • Municipal Commissioner
      • District Magistrate

The elections for the governing body are conducted by the State Election Commission. Any person who is above 18 years is eligible to vote in the elections (certain restrictions do apply. For details please contact the State Election Commission which has its office at Lucknow, Uttar Pradesh). The governing body works within the constitutional framework and the acts made by the Uttar Pradesh Government.

The Executive Wing is headed by the Municipal Commissioner. The Municipal Commissioner is most often a state government officer belonging to the PCS (Provincial Civil Services) cadre and is treated as being on deputation from the state government to us (the ULB). He brings the administrative experience required to execute the day to day works and functioning of the ULB. He is ably assisted by a team of officials belonging to the ULB with a longer tenure at the ULB

Legal Provisions

The 74th amendment act promulgated by the parliament has the following major provisions :
The Uttar Pradesh Government has made many changes related to the framework setup by the 74th constitutional amendment some of which are :

        • Setting up of a State Election Commission
        • Setting up of a State Finance Commission

What We Do

We do a lot of things to make life a better experience in the geographical area specified for us by the state government.

Some of our works are :

          • Creation of Street Light Network and ensuring proper street lighting during night
          • Setting up of a State Finance Commission
          • Creation of Water Supply Network, maintaining it and ensuring that sufficient quantity of water is available for the citizens
          • Creation of Road network and its maintenance
          • Provision of other Civic services like:
            • Birth And Death Registration and issue of necessary certificates
            • Horticulture Development in our area
            • Parks Development and Maintenance

We need your help and support for our efficient functioning. We do things which are vital for your well-being as a citizen. Hence help us help yourself.

We need your help in the following areas :

1. Help us to keep the area clean

          • Do not dump litter on the roads or any public places
          • Dump your litter in the places designated by us only. From these places we regularly collect the waste for dumping in the Dumping yards
          • Do not spit on roads or at public places

2. Help us to control pollution

          • Do not burn plastics or other polluting material around or in your house. This creates lots of fumes and gases harmful to humans and other living beings.
          • Do not smoke in public places. Incidentally this is banned by law.

3.Help us to conserve energy

4. Help us to make the area green

          • Do not uproot or destroy the saplings or trees planted by us
          • Plant more saplings or trees in your surroundings

5.Pay your local taxes promptly

          • Pay your Property Taxes promptly.

Manpower

Nagar Palika requires substantial human resources to discharge its duties effectively.
The various ways through which the work of Nagar Palika is taken up are :

        • The Nagar Palika utilizes either its own human resources for its works or the employees working in Nagar Palika are from the cadre related to Department of urban Development . Else they can come on deputation from other departments to the Nagar Palika also.
        • Employees posted in the Nagar Palika and belonging to the cadre related to Dept. of urban Development
        • Employees on Deputation from other departments (belonging to their own cadre) :

For example the Nagar Swasthya Adhikari is on deputation from the Dept. Of Medical Health. The Municipal Commissioner often belongs to the PCS (Provincial Civil Services) cadre and is treated as on deputation to the Nagar Palika.

Cadre related to Dept. of Urban Development relevant to the Nagar Palika :

The employees working in the Nagar Palika comes from two cadre :

        • Uttar Pradesh Palika Centralised Services Cadre
        • Uttar Pradesh Palika Non-Centralised Services Cadre

Uttar Pradesh Palika Centralised Services Cadre: This is a transferable cadre. The employees belonging to this cadre are governed by the Uttar Pradesh Centralised Services Rules, 1966. The services of this cadre are pensionable.

Uttar Pradesh Palika Non-Centralised Services Cadre: It outsources the entire work.
The Nagar Palika has started to outsource many of the services to third parties. This is essential in today's market driven economy where the more efficient and specialized organisations should be provided with the work wherever required while letting the main organization concentrate on its core strategy and objectives. The outsourcing of large amount of Information Technology and Information technology Enabled Services to India from many organisations belonging to other countries (specially US, UK , Canada , Europe ) reflect this trend.

Funds:

The Nagar Palika requires substantial funds to discharge its duties effectively. World-over the local bodies are provided with portions of tax revenue from the state government (of the state in which they are located) and central government of the country. This is done to provide sufficient funds for enabling the local body to maintain quality of civic infrastructure and civic services for the benefit of citizens living in urban areas. In India there is an elaborate mechanism to provide the funds to the Urban Local Bodies. The 74th constitutional amendment has provided the constitutional basis for Urban Local Self-Government and has also specified the revenue sources for the Urban local Bodies (ULBs)

The various funding sources for the Nagar can be classified as :

          • Conservancy Tax
          • Water Tax

Non-Tax revenues

          • Trade Licenses
          • Birth-Death registration and Certificates Issue
          • Community Bookings of the ULB properties
          • Lease and Rent of ULB Properties
          • Water Charges

2. Part Stamp Duty Collections: Whenever a property is transferred from one owner to another the transfer of ownership is to be registered on the Stamp and need to be registered in Department's Office. Stamp Duty has to be paid for every Property Transfer. The state government has made available ---% of stamp duty for all property transfers occurring in the geographical area of the Urban Local Body. This fund is released by the District magistrate to the ULB.

3. On the recommendation by Central Finance Commission, the Central Finance Commission is constituted in every five years for deciding primarily on the division of revenues between the Central Government and the states in India. The Central Finance Commission also provides the recommendations on the funds to be released out of the revenues of the Central Government to the Urban Local Bodies. As of now the funds are first disbursed to the state government and then Department Of Urban Development through the Directorate Of Local Bodies releases the funds to the Urban Local Bodies. The current Finance Commission is the Twelfth Finance Commission. It is headed by Dr. C. Rangrajan who is the Chairman of the commission. The Commission has its office in New Delhi (at Jawahar Vyapar Bhawan, Tolstoy Marg, new Delhi)

4. On recommendation by State Finance Commission, the State Finance Commission is constituted in every five years for deciding primarily on the division of revenues between the State Government and the institutions of local government like Panchayats and Urban Local Bodies. As of now the funds are disbursed by the Department Of Urban Development through the Directorate Of Local Bodies to the Urban Local Bodies.

Election:

Electoral Process:

The elections of municipalities are conducted by the State Election Commission. Following are the main features of the electoral process for the municipalities:

Election of Members:

The members of the municipality are elected on the basis of adult suffrage.

Electoral Roll for every Ward:

The electoral roll for every ward is prepared under the superintendence and direction of State Election Commission. In Uttar Pradesh the State Election Commission has decided to utilize the Electoral Roll prepared by the CEO Office, UP under the superintendence of Election Commission of India and add ward level details to the Electoral Roll.

Qualification for Election of a Member:

He/She is an elector for any ward in the municipality (urban local body). In the case of a seat reserved for the Scheduled Castes, the Scheduled tribes, the backward classes or the women, the person must belong to the said category, as the case may be. He / she has attained the age of Twenty One years. (confusing text) (was present on existing website)

Disqualification for the Membership:

The provisions of section 13(D) in the municipalities Act 1916 are given below:

A person, notwithstanding that he is otherwise qualified, shall be disqualified for being chosen as and for being a member, of a board if he:

  • Is a dismissed servant of a local authority and is debarred from re-employment there under, or having held any office under the Government of any state has been dismissed for corruption or disloyalty to state, unless a period of six years has elapsed since the dismissal. Is debarred for practicing as a legal practitioner by order of a competent authority or holds any place of profit in the gift or disposal of the Board or is disqualified under section 27 or section 41(Subs. By UP Act No. 15 of 1983. ).Is in the service of the State or the Central Government or any local authority, or is a District Government Counsel or an Additional or Assistant District Government Counsel or an Honorary Munsif or an Honorary Assistant Collector, or Explanation: A government treasurer shall not be deemed to be in the service of the state or the Central Government within the meaning of this clause. Is in arrears in the payment of municipal taxes or other dues in excess of one year's demand to which section 166 applies or(Omitted by UP Act No. 12 of 1994)
    • Is an undischarged insolvent
    • has been convicted of any offence punishable with the imprisonment under section 171-E or an offence punishable under section 171-F of Indian Penal Code, 1860 or has been sentenced to imprisonment for contravention of any order under the Essential Commodities Act, 1955, or the U.P. control of Supplies (Temporary Powers) Act, 1947 as re-enacted by U.P. Control of Supplies (Temporary Powers) Act, 1953 or the Prevention of food Adulteration Act, 1954 or for an offence which is declared by the State Government to involve such moral turpitude as to render him unfit to be a member, or has been ordered to execute a bond for good behaviour in consequence of proceedings under Section 109 or 110 of the Code of Criminal Procedure, 1893 such sentence or order not having been subsequently reversed
  • Is disqualified by or under any law of the time being in force for the purpose of election to the legislature of the state

Provided that in case of (a) and (b) the disqualification may be removed by an order of the State Government in this behalf;
Provided further that in case of (g) the disqualification shall cease as soon as the arrears are paid;

I) the disqualification shall cease on the expiry of five years from the date of his release or from the date of the expiry of the period of which he is required to execute a bond for a good behaviour, as the case may be.

II) the qualification shall not, in the case of a person who is, on the date of disqualification, a member of the board, take effect until three months have elapsed from the date of such disqualification or if within these three months an appeal or petition for revision is brought in respect of conviction or order until that appeal or petition is disposed of.] (confusing text that was already present on the existing website)

Right to Vote:

Any person who is registered with the State Election Commission for a ward can vote in the municipality elections in that ward except the following:
A person can vote in one ward only. If he/she votes in more than one ward his/her votes in all the wards will be cancelled.
He/she is disqualified under the section 12-D of U.P. Municipalities Act, 1916 (described as "Disqualifications for membership" above)
A person cannot vote if he/she is in prison or in lawful custody of Police. This disqualification does not apply to a person subjected to preventive detention under any law for the time being in force.
